SHIPPING DELIVERY GUARANTEE
COVERAGE RULES FOR THE HOMMES ORO SHIPPING DELIVERY GUARANTEE PROGRAM
1. Definitions:
- Carrier means the company that is transporting the Parcel covered by this program.
- Purchaser means the individual(s) who have elected to purchase the Shipping Delivery Guarantee through this program.
- Parcel means packages or shipments transported through parcel carriers.
- Goods means the Hommes Oro products purchased on the Order containing the purchased Shipping Delivery Guarantee.
- Hommes Oro means the guarantor, Hommes Oro, LLC.
- Total Guaranteed Value means the total value of the item(s) declared for coverage and can include shipping fees. Includes the carrier provided coverage, if any.
- Order means a valid order placed by Purchaser on the website www.hommesoro.com or any subdomain and on which the Shipping Delivery Guarantee has been purchased.
- We, us, and our mean Hommes Oro.
- Theft means a Parcel that is stolen outside of a residence or business where it has been commercially delivered, with intent to deprive the rightful owner of the contents.
2. Coverage:
Coverage provided is for all risks of physical loss or damage from an external cause (subject to exclusions) while in transit, and physical loss or damage from theft upon delivery to any Order. Coverage is on a package-by-package basis. Inbound return shipments to Hommes Oro are not covered.
Coverage is for loss, damage, or shortage to the original merchandise shipped plus the original shipping cost (if declared), only.
You acknowledge that the Shipping Delivery Guarantee is provided by Hommes Oro. Hommes Oro is not an insurer.
3. Limits:
This Shipping Delivery Guarantee covers the Goods within any Order that is covered by the Shipping Delivery Guarantee. If there are multiple Parcels in a single Order, only the Goods lost or damaged in the missing Parcel are covered.
- Hommes Oro Shipping Delivery Guarantee only covers one (1) reshipment of Goods covered under a claim made by Purchaser. Refunds are not provided under this program; resolutions are limited to reshipment of the original Goods.
- Hommes Oro Shipping Delivery Guarantee does not cover Orders shipped to the wrong or incorrect address due to information provided by Purchaser.
- Freight forwarding locations are not covered under these protections.
4. Conditions of Use:
CLAIM DISPUTES
- This program shall be construed and interpreted in accordance with the laws of the State of Arizona. The parties agree that any and all claims or disputes arising out of the program or the performance of the program shall be brought in Maricopa County, Arizona.
- The Purchaser agrees to INDEMNIFY AND HOLD HARMLESS Hommes Oro from any loss, liability, damage or costs, including court costs and attorney fees that they may incur due to misreading, misunderstanding, and not following the coverage requirements provided by this program and any applicable endorsements.
CLAIM REQUIREMENTS
4.1 All packaging material and damaged goods must be kept in the original form as received. Packaging and damaged goods should not be disposed of or released to the carrier before a claim is completed as photographs will be required. Failure to comply will result in the denial of the claim due to insufficient packing.
4.2 Concealed damage allows for the discovery of loss or damage up to 5 days after final delivery. The loss is deemed to have possibly occurred during transit. Discovery of loss or damage occurring 6 days or later after final delivery is deemed to have occurred while the shipment was NOT in transit, and therefore, is not covered.
4.3 In case of loss or damage to the covered Parcel due to theft, the following must be completed:
4.3.1 The Purchaser will file immediate notice of non-delivery, damage, or shortage with Hommes Oro. The Purchaser will not file a claim with the Carrier as all rights to the carrier provided coverage are assigned to Hommes Oro.
4.3.2 The Purchaser will provide evidence to support the theft claim. Acceptable forms of evidence include (1) video of the theft occurring, (2) a police report, or (3) carrier confirmation of stolen goods. At least one of these forms of evidence is required for any theft claim, regardless of Order value.
4.3.3 The Purchaser will complete a Hommes Oro claim, as required below, and provide all required documents to Hommes Oro within fifteen (15) calendar days from the date of shipment. If the Carrier has liability and their remittance (Carrier's claim check and stub) or response has not been received by the Purchaser within the 15-day timeframe, all other claim paperwork must be received by Hommes Oro within twenty (20) calendar days from the date of shipment.
4.3.4 A complete claim submission must include:
(a) An email to support@hommesoro.com from the email address you used to place your Order.
(b) Subject line: CLAIM FOR Order #HOMMESORO12345.
(c) Description of your issue or loss.
(d) Hommes Oro support staff will investigate and respond with next steps or additional requests.
4.3.5 Once a claim has been accepted and approved by us, prompt reshipment of the Goods will be made to the Purchaser. Reshipments can only be sent to the address on file with the Order.
4.3.6 Hommes Oro will rely on the determination of responsibility made by the original Carrier to assist in substantiating the loss.
4.3.7 If the shipment is sent by the United States Postal Service (USPS) or consolidators, and the claim is for a loss of the Parcel while in transit, the Purchaser must wait twenty (20) calendar days (Domestic shipments) or forty (40) calendar days (International shipments) before filing claim with Hommes Oro for USPS to trace the package or until USPS has made a final determination of the loss. A claim for a loss in transit may only be filed after the Carrier has made a final determination as to the loss.
4.4 In case the Carrier indicates the Parcel was delivered but the Purchaser did not receive it (including suspected misdelivery, lost in transit after marked delivered, or other carrier error), the following must be completed:
4.4.1 The Purchaser will file immediate notice of non-receipt with Hommes Oro within seven (7) calendar days of the marked delivery date.
4.4.2 Prior to filing a claim with Hommes Oro, the Purchaser must take reasonable steps to locate the Parcel, including (1) checking with neighbors and members of their household, (2) checking surrounding mailboxes and common delivery areas, (3) contacting the Carrier directly to request a delivery investigation or trace, and (4) waiting at least 48 hours after the marked delivery date in case the Parcel is delivered late or mislocated.
4.4.3 If the Parcel is not located after the steps above, the Purchaser must provide one of the following: (1) the Carrier's investigation or trace results confirming non-delivery to the correct address, or (2) a signed statement from the Purchaser attesting to non-receipt.
4.4.4 The Purchaser will complete a Hommes Oro claim, as required below, and provide all required documents to Hommes Oro within fifteen (15) calendar days from the date of shipment.
4.4.5 A complete claim submission must include:
(a) An email to hello@hommesoro.com from the email address you used to place your Order.
(b) Subject line: CLAIM FOR Order #HOMMESORO12345.
(c) Description of your issue or loss.
(d) Hommes Oro support staff will investigate and respond with next steps or additional requests.
4.4.6 Once a claim has been accepted and approved by us, prompt reshipment of the Goods will be made to the Purchaser. Reshipments can only be sent to the address on file with the Order.
4.5 In case of loss or damage to the covered Parcel, the following must be completed:
4.5.1 The Purchaser will file immediate notice of non-delivery, damage, or shortage with Hommes Oro. The Purchaser will not file a claim with the Carrier as all rights to the carrier provided coverage are assigned to Hommes Oro.
4.5.2 The Purchaser will complete a Hommes Oro claim, as required below, and provide all required documents to Hommes Oro within fifteen (15) calendar days from the date of shipment. If the Carrier has liability and their remittance (Carrier's claim check and stub) or response has not been received by the Purchaser within the 15-day timeframe, all other claim paperwork must be received by Hommes Oro within twenty (20) calendar days from the date of shipment.

OTHER INSURANCE
- This program is excess coverage if there is other insurance coverage. After the other insurance has paid up to its limit, our program will provide coverage up to its limit, but not exceeding the remainder of the loss.
SIGNATURE CONFIRMATION SERVICE
- Hommes Oro may require direct or adult Signature Confirmation Service provided by the Carrier (must be signed for at delivery) for Goods reshipped under a claim.
- Any Orders delivered by a Carrier with a Signature Confirmation Service are not eligible for coverage under this policy if the Order confirmation contains a valid signature.
